Majority — INEXPEDIENT TO LEGISLATE

Rep. Mike Belcher

This bill proposes extending the Education Freedom Account cap through the 2026-2027 school year. It is feared that this cap might not be constitutional, as, while courts have been friendly to means-tested exclusion, discrimination without cause and arbitrary limits on public programs have not been treated so kindly by the courts. Ethically, such an arbitrary exclusion policy lacks for a firm foundation. Further, the bill has an error in the implementation timeline, making the bill go into effect after the beginning of the 2026-2027 school year, which would have the effect of kicking more than 800 families out of the program, and jeopardizing their education, just after the school year has begun. Vote 10-8.

Minority — OUGHT TO PASS

The minority of the committee believes this bill should be Ought to Pass in order to protect the financial interests of New Hampshire citizens. When this bill was first introduced, the fiscal note wasn’t completed yet. The fiscal note which was finished and added on January 12th indicates that this bill would save taxpayers $6.2 million in 2027, but it’s actually much more than that. The fiscal note estimates that under this bill, in which the caps stay at 10,000 students, the number of students in the program in 2027 will be 11,250 because about 1,250 students will have priority status. The fiscal note then states that under current law where the cap automatically increases, the program will grow to 12,500 students next year. But the fiscal note does not take those priority students into account when estimating the cost under current law. The real estimate under current law is 13,750 students next year, because the same 1,250 priority students will have priority status. The actual taxpayer savings under this bill is $12.4 million, double what the fiscal note indicates. Additionally, the legislature only budgeted enough funds for 9,541 students next year ($47.8 million in budget; $5,010 cost per student), so even with this bill, we’re still overspending on Education Freedom Account (EFA) funds. Additionally, (1) this bill only affects upper-income families that aren’t already in the voucher program; (2) because the priority status is unchanged in this bill, any family new under 350% poverty will still be able to access the voucher program even when the cap is hit; and (3) this bill saves taxpayers over $12 million by simply keeping the EFA program as is, and not expanding it to an additional 2,500 wealthy households next year.
