Majority — OUGHT TO PASS WITH AMENDMENT

Rep. Mike Belcher

This bill, as amended, proposes to add a new priority group to the Education Freedom Account program for students residing in NH with one or more parents or guardians who are on active military duty. This priority group would not be subject to the program’s enrollment cap, to guarantee choice in education for the children of these servicemen and women who sacrifice so much for our nation and our state. Vote 10-8.

Minority — INEXPEDIENT TO LEGISLATE

This bill is another expansion of the Education Freedom Account (EFA) program which is already universally available to all NH students and $13 million over budget this year. The fiscal impact of this bill cannot be determined as it is unclear how many additional students would qualify for this additional category priority status and exactly how residency would be determined. The amendment attempts to clarify student residency but is subject to legal interpretation. Currently, there is an LBA (Office of the Legislative Budget Assistant) performance audit of the program underway, and the Education Freedom Account Oversight Committee has yet to meet this year to review new data provided by the Department of Education and the Children’s Scholarship Fund. There have been issues raised about the program, including reporting of educational attainment, eligibility for special education differentiated funds, and vendor expenditures. The minority is opposed to all expansion of the EFA program as there is no reliable and continuous accountability and transparency available at this time.
