Committee — INEXPEDIENT TO LEGISLATE
This bill would create a lawyer licensing and disciplinary board separate from – and in addition to – the Judicial Branch’s operation of its admissions and disciplinary functions. The committee opposes the bill. First, the bill is fiscally irresponsible. While it makes a one-time appropriation of $500,000 from the General Fund to establish the board, future operation costs are indeterminable. Put another way, significant questions remain as to whether non-General Fund sources will amount to revenue adequate to cover future expenses. Second, the bill would undermine well-settled constitutional principles, including separation of powers. Federal and state court decisions have established that the regulation of the practice of law, including admission to the bar and regulation of attorneys, is a judiciary function. Third, it is unclear what problem this legislation is attempting to resolve, further calling into question the need for yet another layer of regulatory oversight. Vote 16-0.
