Majority — INEXPEDIENT TO LEGISLATE
This bill is seen as a serious constitutional threat to the Education Freedom Account (EFA) program, as it changes the current paradigm, which the courts refused to strike down and thereby upheld as lawful, by changing oversight and administration of the EFA grants (made to parents) to the jurisdiction of the Department of Education. This fundamental change to the program might legally undermine the nature of these grants, whereby, once made, the funds belong to the parents to be expended towards the education of their children. By changing the paradigm to have these funds distributed directly from the New Hampshire government to certain institutions that parents have decided to send their children to the program might then transgress Article 83 of the New Hampshire Constitution. Further, the bill was advertised as being a cost-saving measure, but the bill itself authorizes more funds to the department than are currently expended in administration of the program. Vote 10-8.
Minority — OUGHT TO PASS
The minority is against the Inexpedient to Legislate motion on this bill that has the NH Department of Education (DOE) administer the Education Freedom Account program, which would make the program more directly accountable to NH residents, lawmakers, and auditors. This bill does not change EFA eligibility and it remains a grant transferred to the student’s EFA account. Administration by the DOE would provide oversight, accountability, and transparency, which we all prize. There presently are 10,510 students receiving EFAs at a cost of $52 million. The administration cost of up 10% would be $5 million. The minority believes that the $5 million raised from NH taxpayer dollars should remain in NH. We have trust that the DOE is capable of administering this program.
