Majority — INEXPEDIENT TO LEGISLATE
This bill is yet another attempt designed to prohibit students from maximizing upon available financial resources in support of school choice. If passed, this bill would render a recipient of an Education Tax Credit scholarship ineligible to receive Education Freedom Account funds in the same program year. Both the Education Tax Credit and the Education Freedom Account programs provide parents and students more of an educational return on their dollar than remaining in a school not delivering and meeting social, emotional, or academic needs. When a student leaves a public school district, the residents no longer pay the local portion of public school tuition for the student. In short, the Education Freedom Account has been a lifeline for thousands of students all around New Hampshire. The Education Tax Credit program, established in 2012, promotes another school choice program that is revenue neutral. The tax credit applies to the business’s business enterprise tax or business profits tax liability. Financial support directed to the Children’s Scholarship Fund, from businesses receiving tax credits, enables parents of limited means to send their kids to a non-public school, or different public school that agrees to accept them. Currently, a parent may apply to the Children’s Scholarship Fund for funds available from both the Education Freedom Account and the Education Tax Credit programs. On average, the Education Freedom Account award is approximately $4,900 to $5,300 per pupil and the Education Tax Credit is approximately $4,911 per pupil and, when combined, accessibility to a non-public school or other alternative choice program is attainable. This bill is squarely aimed at undermining New Hampshire’s exceptionally strong and rapidly growing choice programs. Over the years, including the present, the legislature has increased public school spending significantly, but the outcomes remain flat. Up to this point in time, only a small fraction of the public school system student total enrollment has opted for choice; however, for those who have, they are receiving a better return on the dollar that meets their social, emotional, and academic needs. This bill disregards our responsibility to meet the needs of all children, including families and students who don’t fit into a one-size-fits-all system. Vote 10-8.
Minority — OUGHT TO PASS
This bill will prevent students from participating in both the Education Freedom Accounts (EFA) and Education Tax Credit (ETC) programs at the same time. The cost for these two programs will be $56,000,000 this year. The ETC, established 15 years ago, currently has 655 students with an average grant of $3,400, though some receive over $5,000. The EFA program has 10,600 students with an average grant of $4,900. Both programs are administered by the Children’s Scholarship Fund. The fiscal analysis for this bill revealed that 95% of ETC recipients also receive EFA grants. Some are receiving more than $10,000 per year. This two-program double dipping is unfair, and there is no evidence legislators expected this to happen. Limiting students to one program will make room for as many as 1,000 additional ETC recipients. The bill also clarifies the existing requirement that Virtual Learning Academy Charter School (VLACS) tuition must be paid from EFA grants, not billed separately to the state by VLACS. The VLACS correction is projected to reduce state expenditures by approximately $900,000 next year.
