Majority — INEXPEDIENT TO LEGISLATE
This bill proposes adding coverage for diapers under the state Medicaid program. During the public hearing, the committee heard heartfelt testimony from parents and advocates about the challenges of affording diapers and the positive impact such support could have on families. The committee approached the bill with compassion and recognizes the importance of supporting families in need. After careful consideration, the majority concluded that, while the intent of the bill is commendable, expanding Medicaid to cover diapers would be an unnecessary increase in state spending, as other organizations are already providing significant assistance in this area. Therefore, the majority recommends Inexpedient to Legislate. Vote 10-8. Rep. Lucy Weber for 15 6 FEBRUARY 2026 HOUSE RECORD the Minority of Health, Human Services and Elderly Affairs. This bill directs the Department of Health and Human Services to submit a waiver for Medicaid to provide new mothers with 100 diapers per month during the first year of their infant’s life. The cost of diapers can amount to $1200 for the first year of life, and SNAP benefits may not be used to cover diapers. This can be a huge strain on a limited budget. Rationing of diapers leads to rashes, skin breakdown, and urinary tract infections. In addition, if the mother is working and the infant goes to day care, diapers must be supplied with the infant. If the mother has no diapers, she must miss work because she cannot send her infant to day care. There are some voluntary programs in the state which provide diapers to mothers in need, but they do not cover the whole state, and 100 diapers per month does not meet the individual monthly need, so voluntary help will always be necessary. Amendment 2026-0394(h) clarifies that the bill provides coverage only to mothers who qualify for the Medicaid benefit, which is a smaller number of recipients than the whole number of children who qualify. The fiscal note was based on all children who qualify for the Medicaid benefit, so the program would cost significantly less than indicated by the fiscal note. Members of the minority believe this is common-sense, family-friendly legislation which would help mothers give their infants a healthy start to life.
