Majority — INEXPEDIENT TO LEGISLATE

This bill creates a new grant program to help colleges support developmentally disabled students. $100,000 is allocated for the purpose. All colleges comply with the Americans with Disabilities Act to accommodate disabilities. NH public colleges and universities have detailed internal budgets, but the funding from the state is a lump sum. If the colleges see a benefit in this program, they can include it in their own budgets. The University of New Hampshire previously had a similar program based on federal grants, but decided to drop it. The state funds the colleges in the biennial budget. Revenues in the six months since the budget passed have been poor, and extra funds are not available for this purpose. Vote 10-8.

The bill establishes an inclusive postsecondary and career preparation program for students with developmental disabilities and makes an appropriation. The amendment replaces the original language by paring back the scope of the bill and assigning responsibility to the Community College System of New Hampshire (CCSNH), targeting the largest audience and requiring progress reports to the Public Higher Education Study Committee every six months. The receipt of a high school diploma, while indicative of success at the secondary level, for students on an Individualized Education Plan (IEP), this important step does not mean the student is disability-free. Transition programs designed to support students in postsecondary programs are offered in every state in the union, except New Hampshire. This bill would begin rectifying that deficiency by authorizing and funding an Inclusive Postsecondary Education (IPSE) and Career Preparation Pilot Program in the CCSNH which now counts approximately 1,000 students in this category over the seven CCSNH campuses. Manchester Community College is typical with one accessibility counselor working with over 250 students, often with multiple diagnoses, including autism spectrum disorder, learning disabilities, attention deficit and speech and language disorders, and traumatic brain injury. While doing incredible work, they are stretched too thin and have asked for this program. This bill provides students with developmental disabilities support and experience necessary to seek and sustain competitive employment. Some suggest they already have an adequate tool through Title 504 of the Americans with Disabilities Act. That is profoundly untrue. IPSE programs provide specialized instruction, therapies (speech, occupational, or counseling), individualized goals, accommodations, and assistive technology. Progress is monitored regularly. A 504 Plan provides accommodations only – no support plan.
