Committee — OUGHT TO PASS WITH AMENDMENT
This bill restricts the retail sale of second-generation anticoagulant rodenticides (SGARs) to individuals who are licensed or registered with the Department of Agriculture, Markets, and Food (DAMF), including certified pest control professionals and registered agricultural operators. SGARs are highly toxic and persistent, and their misuse has contributed to secondary poisoning of non-target wildlife, including birds of prey and other predators that consume contaminated rodents. The committee amendment narrows the bill’s scope by excluding non-SGAR rodenticides such as bromethalin and cholecalciferol, as well as zinc phosphide, which is already restricted, ensuring the bill remains targeted to SGARs’ unique secondary poisoning risks. The amended bill also closes a key enforcement gap by addressing remote sales. It prohibits the sale of covered SGAR products via internet, catalog, or other remote methods to any purchaser in New Hampshire unless the seller verifies the purchaser’s required license or registration status. In addition, online marketplaces are prohibited from listing covered products for direct-to-consumer sale without license verification. The majority of the committee believes this bill as amended provides a balanced approach that curbs preventable wildlife poisoning and consumer misuse while preserving access to effective rodent control tools for trained professionals and agricultural operators. Vote 13-2.
