Majority — OUGHT TO PASS WITH AMENDMENT
Lakes in New Hampshire are treasured for their natural beauty, recreational opportunities, and role in the state’s essential tourism economy. The vast majority of these lakes have dams, which raise the water to the level enjoyed and expected by summer lake-lovers. The dams were built long ago, and the state took ownership of many of them in the mid twentieth century. Over time, maintenance has fallen behind due to lack of funds, and now approximately $300 million are needed to repair “high-hazard” dams, defined as likely resulting in loss of life if the dam should fail. While intimidating, NH Department of Environmental Services (DES) states catastrophe can be avoided with annual funding of approximately $16 million. However, on average, only $7.5 million is available annually from a combination of diminishing hydropower leases, the capital budget, and general funds. This bill helps to close that gap by charging a fee of $100 annually to waterfront property owners and $50 to those with deeded access to waterbodies impounded by state owned dams. Since the lake water level controlled by dams directly contributes to property values and recreational opportunities, this bill adheres to the Granite State tradition of asking those who benefit from a resource to contribute in helping to pay for it. As the funds raised only partially address the gap, additional sources will continue to be sought to avoid overburdening a single group. The fee is collected by municipalities and sent to the Department of Revenue Administration for deposit into the existing dam maintenance fund administered by DES. The amendment clarifies language as requested by the DES. Vote 10-6.
Minority — INEXPEDIENT TO LEGISLATE
This bill is fundamentally flawed in equity and fiscal policy. This bill singles out waterfront property owners for new annual fees: $100 for direct access, $50 for deeded rights, despite the fact that state-owned dams provide broad public benefits, including flood control, recreation, and environmental protection, enjoyed by all residents, not just those living on the water. Waterfront owners already pay higher property taxes due to elevated assessments, with no current statewide dam maintenance fees, making this proposal a form of unfair targeting of waterfront property owners. Moreover, the revenue generated would be negligible relative to the $400 million backlog in dam repairs; only gets the money backlog 1/2 way there. This approach unfairly burdens a small group while failing to solve the underlying infrastructure crisis. Other states successfully fund dam maintenance through general revenue, bonds, and federal grants, mechanisms that distribute costs equitably and leverage substantial outside resources. New Hampshire should pursue these proven, broad-based solutions rather than imposing narrow, insufficient fees on lakefront property owners.
