Majority — OUGHT TO PASS WITH AMENDMENT
This bill directs the Department of Health and Human Services (DHHS) to provide notice of medical and religious exemptions from immunization requirements. It also states that any written, signed statement attesting to a religious objection shall be sufficient. The bill creates an even playing field. It balances government-issued, one-sided advertisements for commercial medications by informing patients of their existing rights based on personal beliefs, medical needs, and medical sensitivities. The original bill also required DHHS to submit an annual compliance report. The committee amendment removes this provision to address the primary source of potential increased fiscal impact. Additionally, the committee amendment eliminates the new penalty language. It instead aligns enforcement with DHHS’s existing reporting and disciplinary processes. Vote 10-8.
Minority — INEXPEDIENT TO LEGISLATE
The members of the minority believe that it should be voted Inexpedient to Legislate because, as noted by the Governor when she vetoed a similar bill less than one year ago, “the state already has an established process by which parents can claim a religious exemption.” The form currently in use is easy to locate on the Department of Health and Human Services (DHHS) website and said form provides a practical method of record keeping by school nurses that allows them to efficiently track immunization records during a disease outbreak.
