Committee — REFER FOR INTERIM STUDY
This bill aims to build upon a recently enacted law, HB 369 (Ch. 182, Laws of 2025), which came into effect on January 1, 2026. This law provides protection for minors under 18 8 6 FEBRUARY 2026 HOUSE RECORD involved in misdemeanor sexual assault cases by requiring the defendant to opt for a circuit court trial and waive the right to a jury trial, or appeal directly to the superior court for a jury trial. The purpose of this provision was to spare minor survivors of sexual assault from the burden of enduring two separate trials and reliving their trauma. The proposed expansion of the bill aims to eliminate the age restriction, extending its applicability to all victims regardless of age, and broaden the covered case types to include simple assault, stalking, and domestic violence. While acknowledging the potential merit of the bill, the committee expressed the importance of evaluating the impact of the law that took effect on January 1st before considering further expansion, particularly in light of the significant fiscal implications. Vote 18-0.
