Committee — INEXPEDIENT TO LEGISLATE
This bill would have identified conditions in which an appointed alternate or elected member of a local land use board may be removed from office. Currently, RSA 673:13 Removal of Members, states, “After public hearing, appointed members and alternate members of an appointed local land use board may be removed by the appointing authority upon written findings of inefficiency, neglect of duty, or malfeasance in office.” This bill would have expanded the definition of member to include “an elected, appointed, ex-officio, or alternate member of a planning board, zoning board of adjustment, board committee or subcommittee, council, select board, select board committee, or county or district commission.” This proposed bill would be in conflict with RSA 42:1 and RSA 42:1-a. Both current laws describe the manner of dismissing a town official under certain conditions, such as not complying with the oath of office by not upholding the New Hampshire or US Constitutions, or by not discharging public duties consistent with New Hampshire law and regulations. Based on this conflict, the committee voted to recommend the bill Inexpedient to Legislate. Vote 18-0.
