This bill allows school districts to borrow and categorize funds as revenue, so long as they are only used for the same purpose as the anticipated fund source. Reimbursement anticipation note funds come from two sources, RSA 186-C:18 (special education aid) and RSA 198:42 (adequacy education grants). The governing body, after notice and public hearing, may elect to borrow such funds and recognize the proceeds of the borrowing as revenue for property tax rate setting purposes by providing written notification to the Commissioner of the Department of Revenue Administration stating the specific amount of borrowing to be recognized as revenue. A reimbursement anticipation note (RAN) is often considered a short-term financial tool used by districts to cover temporary cash flow gaps while waiting for expected revenues from sources such as taxes or grants. If a district decides to borrow funds from projected, then this bill requires the district to use said funds toward resource elements and services necessary to deliver criteria and key elements associated with adequacy. The same scenario is applicable to funds derived from special education. The primary purpose for adequacy and special education funds is for those services, not for other non-related purposes. Vote 10-8.

Minority — INEXPEDIENT TO LEGISLATE

The minority finds this bill unnecessary and unrealistic to implement. Given that statute already acknowledges use of differentiated aid funds for all educational needs including operating costs of the district, tying reimbursement anticipation notes (RAN) to specific purposes is inappropriate. This bill could substantially narrow the ability of a district to borrow needed funds.
