Committee — OUGHT TO PASS
This is a narrowly tailored bill that addresses a clear procedural issue in local land-use decision-making. The bill allows individuals to sit on both a planning board and a zoning board of adjustment (ZBA) as either a member or alternate, but restricts the individual from sitting on cases which have, or will likely be heard by both boards. This bill is a companion to HB 92 of the 2025 session which delineates the same restrictions, but from the perspective of a ZBA member. This bill does not prohibit dual service on both planning and zoning boards. It provides a simple, bright-line rule requiring recusal in limited circumstances to avoid conflicts, preserve impartiality, and protect the integrity of the record. That clarity benefits applicants, boards, and municipalities alike, and helps reduce the risk of appeal based on procedural error. Vote 18-0.
