This bill will help make child support payments more equitable as it allows deductions from an obligor’s income to help offset the inability of an obligor to deduct child payments from income taxes. Child support payments are not tax free to the obligee. Vote 9-6.

Minority — INEXPEDIENT TO LEGISLATE

The minority recommends Inexpedient to Legislate for this bill because it creates an unfair double deduction that would reduce financial support to children based on inaccurate reasoning. The New Hampshire child support calculator already deducts federal taxes, Social Security, and Medicare from both parties’ gross incomes before calculating support obligations, as confirmed by testimony from New Hampshire Legal Assistance. This bill would allow obligors to take a second deduction for these same taxes, effectively giving them two bites at the apple while reducing support payments by approximately 3.8 to 4 percent, or roughly $588 annually on a typical order. The sponsor’s argument that child support is tax-free to recipients ignores the fact that custodial parents pay taxes on their own earnings while bearing the majority of child-rearing costs, and the claim that this creates equity between employees and self-employed obligors misunderstands how self-employment tax works. The current system already treats both parties fairly by reducing both incomes proportionally, and courts retain discretion to modify support in cases of genuine hardship. No evidence was presented of any systematic problem with the current calculation method, and while there is an amendment passed to clarify the technical language, it does not address the fundamental double-deduction flaw. The minority believes that children’s financial needs should take priority over a perceived tax inequity that does not actually exist.
