Committee — INEXPEDIENT TO LEGISLATE
This bill eliminates the requirement of RSA 676:7, I(b) that Zoning Boards of Adjustment post hearing notices in newspapers of general circulation five days prior to the hearing date. The bill proposes that hearing notices be posted on a municipality’s website or in two public places if the municipality does not have a website. Proponents of the bill stated that people look online for information and many do not read newspapers. They also cited the financial savings to the applicant if they did not have to pay for the cost of a newspaper ad in addition to abutter notification by mail. People not in support of the bill pointed out that access to information is not notification and that publication in a newspaper provided independent, third party, verification that the public was properly noticed. It was also noted that most, if not all, New Hampshire newspapers do not put legal notices behind a paywall in their online versions, so there is no need to subscribe to the publication in order to view these public notices. Vote 17-0.
