The amendment 2026-0532h is a nongermane amendment that completely replaces the original bill, redirecting it from prohibiting the extraction of groundwater into plastic water bottles to a much more urgent and actionable fix for New Hampshire’s outdated mining permit system. Given that no new water bottling plants are opening in NH, and that NH Department of Environmental Services (NHDES) explains that since 1998 only one large water plant has received a permit, municipal public water systems will have an impact when selling to beverage manufacturers, and the criteria for determining what type of material is used. Today, plastic water bottles remain the most efficient and reliable way to deliver safe water in emergencies. Supporting the Ought to Pass with Amendment position with the non-germane amendment ensures the legislature changes the permitting and fee authority for mining and prospecting, which is needed because the current system, administered by the NH Department of Natural and Cultural Resources (DNCR) under outdated statutes, has proven confusing, slow, and prohibitively expensive for applicants, as shown by a mining business in Acworth that took years and roughly $40,000 to resolve. Transferring primary authority to NHDES, which already manages alteration-ofterrain and related land-use permits, will streamline reviews, align fees with the level of technical oversight required, and provide clearer, more predictable standards for both regulators and businesses. Vote 16-0.
