This bill as proposed, if passed, would repeal rights recently restored to property owners under SB 281 in 2025. SB 281 as passed on a voice vote restores the rights of property owners to build on class VI roads with adequate protections to the municipality. SB 281 as passed and signed by the Governor, takes effect July 1, 2026 and significantly increases the potential for development and building of new housing at a critical time of housing shortage when buildable property is at a premium and an increase in available buildable property will moderate housing costs and increase supply. This bill repeals and replaces RSA 674:41, I(c) as amended with the old highly restrictive anti-development wording. This bill as proposed and if passed would lead to extensive confusion and conflict between property owners and municipalities that have only recently had the opportunity to anticipate the new freedoms granted in the last session. The committee finds this bill in conflict with bipartisan legislation passed overwhelmingly in the last session by voice vote. The committee unanimously supports a motion of Inexpedient to Legislate.
