Majority — OUGHT TO PASS WITH AMENDMENT
The concerns surrounding this bill are related to the safety of the public. Testimony indicated that handguns can already be carried with a bullet in the chamber. This bill relates to long guns or rifles. Gun safety is always a concern. The amendment to this bill provides for exceptions on private property with owners express or implied permission of the property owner. The bill as amended supports Second Amendment rights of our citizens. Vote 9-7.
Minority — INEXPEDIENT TO LEGISLATE
This legislation would allow a person to carry a loaded firearm while on a snowmobile on private property, when the user has received express or implied permission from the landowner. This legislation was opposed 9-1 by the bipartisan Fish and Game Commission as it does not adhere to the safe handling of firearms or basic tenets of hunter safety. There was also uncertainty around whether landowners would be protected by landowner liability laws, how implied permission was determined, and if this legislation would lead to more trails being closed to public use because of private owner concerns about liability. Snowmobile operators are already allowed to carry a loaded sidearm or pistol under constitutional carry; they can also have a full magazine in a firearm without a round in the chamber. An amendment to the bill opens the door to hunting from moving vehicles; this violates the notion of fair chase hunting, an honor code of American hunters for more than a century dating back to Teddy Roosevelt.
