Majority — INEXPEDIENT TO LEGISLATE
The majority of the committee on State-Federal Relations and Veterans Affairs sees this bill as creating unnecessary risks while unfairly burdening granite state citizens and communities. This legislation seems straightforward, but it invites complicated consequences that would prove costly to NH in several ways. Our state has a long tradition of putting politics aside to support our active-duty service people, especially those who risk making the ultimate sacrifice while protecting our national interests and the freedoms we hold dear. National Guard members competently sign contracts and are fully aware of possible overseas deployments. Defending our guard should mean making sure it has funding and access to the latest equipment/training so it may be instantly ready if called upon for various missions, including overseas missions. There are nuances here that deserve attention. Our National Guard receives considerable federal funding which entails federal expectations. It is part of the Ready Reserve as a component of the Army/Air National Guard of the United States. Default status, i.e. Title 32 status, sets the terms by which National Guard forces train for war while under the command of a state governor. The Governor can call the National Guard into state service at state expense. If the President cannot similarly utilize our National Guard when needed, then why would the federal government continue to subsidize our National Guard? New Hampshire’s guard has long supported stateside/remote Title 10 missions while providing a significant portion of overall national military power, in some cases taking on specialized missions that would be difficult to replicate elsewhere. That National Guard units have less turnover than their active-duty counterparts ensures the retention of valuable institutional knowledge. A good example is the refueler program, which other states would like to host. Losing this capability would be a significant blow to our joint force’s overall capabilities with huge local financial implications. Service members and their families rely on authorities to uphold their end of service contracts. The NH National Guard receives at least $395 million in federal funding annually. Federal funding not included in state appropriations totals $200 million annually, which covers military/ civilian pay, including benefits. This includes $140 million/year (for construction, operations, and maintenance), $33 million annually for the state operations, and $22 million for the state capital budget each year. Significantly, our federal constitution does not allow governors to refuse consent to the use of the guard. Governors only get input because Congress allows it and only on terms which Congress has set, as in 10 USC § 12301. Furthermore, our federal constitution doesn’t require Congress to issue a formal declaration of war to take certain military actions. What matters is legislative approval — such as an authorization for the use of military force (AUMF). The constitutional requirement involves legislative approval but not necessarily a Declaration of War. While the notion of “no more wars without a congressional declaration” is well-intended, addressing sponsor concerns by isolating NH from defense missions does nothing to change policies rooted at the national level. As state legislators we need to be wary of unintended consequences, and those pesky fiscal and social impacts that subsequently trickle down into our communities. Many have worked hard to overcome historical stigmas relating to the National Guard, building it up to the impressive organization we know today. People join the National Guard for many reasons, and all have their own unique experiences. To take some of these opportunities away from guard members and potential guard members would be detrimental to individuals while severely limiting our circumstances vis-a-vis other states. It’s an individual choice to chart a course in life that includes bravely serving in uniform. While we respect this proposed bill’s potential for raising awareness re: National Guard/Joint Force missions and dangerous overseas deployments, that awareness could be better raised via a resolution that seeks accountability while addressing the issue of force authorization, as opposed to passing a statute that is not supported by the organization that this bill purports to support—our NH National Guard. Vote 11-6.

The minority of the committee believes the Defend the Guard Act remains the most proactive measure New Hampshire can take to hold Congress accountable for abdicating its constitutionally granted warmaking authority to the Executive Branch for the last half century. We have seen “forever wars” of the 21st century rage on, destabilizing nations, killing hundreds of thousands, displacing millions, creating new enemies like ISIS, and handing over an entire nation to Al-Qaida with the ascension of Abu Mohammed Al›Julani in Syria – all without a formal War Declaration by Congress. Our men and women in uniform swear an oath to the defend the Constitution, but the politicians in Washington, D.C. won’t follow the processes outlined by our founders before sending them off to fight for nebulous causes that have no clear objective. It is time for New Hampshire to stand up for these men and women in uniform, as Daniel Webster did with his quote: “It will be the solemn duty of the State Governments to protect their own authority over their own Militia, and to interpose between their citizens and arbitrary power.” Therefore, the minority opposes the Inexpedient to Legislate Motion in favor of Ought to Pass with Amendment.
