The committee felt that this legislation was not needed as there is no requirement for a municipality to enter into any agreement for a payment in lieu of taxes (PILOT) agreement with a renewable generation facility. RSA 72:74 makes this very clear, and states, “the governing body of the municipality in which the facility is located may, after a duly noticed public hearing, enter into a voluntary agreement to make a payment in lieu of taxes.” Not shall, but may. Testimony also revealed that municipalities have multiple times in the past rejected such PILOT agreements. Vote 18-0.
