Majority — OUGHT TO PASS
This Constitutional Amendment Concurrent Resolution would place the requirement of US citizenship for holding state office in the New Hampshire Constitution, ensuring that this fundamental qualification is clearly established in the state’s highest law. While current statutes address this requirement, statutes may be amended by future legislatures. Constitutional placement provides permanence, clarity, and uniformity regarding eligibility for public office. The amendment does not alter existing qualifications beyond citizenship, nor does it distinguish between natural-born and naturalized citizens. Rather, it affirms a longstanding principle that those exercising the authority of state government should be citizens of the United States. Vote 10-6.
Minority — INEXPEDIENT TO LEGISLATE
This Constitutional Amendment Concurrent Resolution is unnecessary, duplicative, and potentially harmful. US citizenship for state office is already required under RSA 655:1, and no evidence shows that the statute is unclear, unenforceable, or constitutionally deficient. The amendment risks creating tension between statutory and constitutional language while inviting future efforts to expand eligibility restrictions, including proposals such as a “natural born citizen” requirement that would exclude naturalized 40 27 FEBRUARY 2026 HOUSE RECORD citizens. Public testimony overwhelmingly opposed the amendment as addressing a nonexistent problem and reinforcing fearbased narratives about elections. Because the structural framework of the constitution functions effectively, there is no need to amend it. For these reasons, the minority recommends finding this Constitutional Amendment Concurrent Resolution Inexpedient to Legislate.
