HB 1093 (2024)

prohibiting mandatory mask policies in schools.

  • Status: Vetoed, override failed
  • Term: 2023-2024
  • House committee: Education
  • Senate committee: Health and Human Services
  • Subject: Education - General

The Story

It was introduced on January 3, 2024 and referred to the House Education committee. The committee held a public hearing on March 5, 2024, with 543 people signed in online: 415 in support, 125 in opposition and 3 as neutral. The committee met in executive session on March 6, 2024 and March 18, 2024. The committee recommended, on a tied vote of 10–10, which carries no majority, that the House make no recommendation, and the report was placed on the regular calendar. A floor amendment (2024-0911h) was adopted on a division vote 172–163 on March 28, 2024, changing the text of the bill. On March 28, 2024 the House voted to pass it with changes on a roll call 187–184. It crossed to the Senate and was referred to the Senate Health and Human Services committee. The committee held a public hearing on April 17, 2024. The committee voted 3–2 to recommend that the Senate pass it. On May 22, 2024 the Senate voted to pass it on a voice vote and ordered it to a third reading. The bill was enrolled on June 13, 2024 — the final check of the text before it goes to the governor. The governor vetoed it on July 3, 2024. The legislature can override a veto with a two-thirds vote in both chambers. On October 10, 2024 the House voted 160–172 on overriding the governor's veto on a roll call, and the veto was sustained, failing to meet the two thirds threshold.
