HB 275 (2022)

relative to the declaration of a state of emergency.

  • Status: Vetoed, override failed
  • Term: 2021-2022
  • House committee: Executive Departments and Administration
  • Senate committee: Executive Departments and Administration
  • Subject: State Government

The Story

It was introduced on January 6, 2021 and referred to the House Executive Departments and Administration committee. The committee held a work session on March 1, 2021. The committee retained the bill, holding it for further work rather than reporting it out this year. The committee held a work session on September 7, 2021. The committee met in executive session on October 25, 2021 and November 8, 2021. The majority recommended that the House pass it with changes (amendment 2021-2235h), and the minority recommended that the House kill it, by a vote of 10–8. The report was placed on the regular calendar. The committee's amendment (2021-2235h) was adopted on a voice vote on January 6, 2022, changing the text of the bill. On January 6, 2022 the House voted to pass it with changes on a roll call 190–165. On January 6, 2022 the House failed “Reconsider” on a division vote 170–184, on a motion by Rep. Keith Ammon. It crossed to the Senate and was referred to the Senate Executive Departments and Administration committee. The committee held a public hearing on April 6, 2022. The committee voted unanimously, 5–0, to recommend that the Senate pass it, and the report was placed on the consent calendar. On April 28, 2022 the Senate voted to pass it on a voice vote, then referred it on to the Senate Finance committee. The committee recommended that the Senate pass it. On May 5, 2022 the Senate adopted “Special Order to after the Bills removed from the Consent Calendar, Without Objection”. On May 5, 2022 the Senate voted to pass it on a voice vote and ordered it to a third reading. The bill was enrolled on May 12, 2022 — the final check of the text before it goes to the governor. The governor vetoed it on May 27, 2022. The legislature can override a veto with a two-thirds vote in both chambers. On September 15, 2022 the House voted 157–167 on overriding the governor's veto on a roll call, and the veto was sustained, failing to meet the two thirds threshold.
