HB 238 (2022)

prohibiting provocations based on a victim’s actual or perceived gender, gender identity, gender expression, or sexual orientation from being used as a defense in manslaughter cases.

  • Status: Died on the table
  • Term: 2021-2022
  • House committee: Criminal Justice and Public Safety
  • Senate committee: Judiciary
  • Subject: Crimes, Criminal Procedure and Corrections

The Story

It was introduced on January 6, 2021 and referred to the House Criminal Justice and Public Safety committee. The committee retained the bill, holding it for further work rather than reporting it out this year. The committee held a work session on October 5, 2021. The majority recommended that the House pass it, and the minority recommended that the House kill it, by a vote of 13–8. The report was placed on the regular calendar. On January 6, 2022 the House voted to pass it on a roll call 223–118. It crossed to the Senate and was referred to the Senate Judiciary committee. The committee held a public hearing on April 14, 2022. The committee recommended that the Senate study it after the session ends. On May 5, 2022 the Senate failed “Refer to Interim Study, RC 12Y-12N”. On May 5, 2022 the Senate voted to lay it on the table on a voice vote, on a motion by Sen. Bradley. The bill died on the table under Senate Rule 3-23 at adjournment on September 15, 2022, having been set aside and never taken back up.
