HB 239-FN (2021)

relative to prosecutions for certain assaults against minors.

  • Status: Vetoed, override failed
  • Term: 2021-2022
  • House committee: Criminal Justice and Public Safety
  • Senate committee: Judiciary
  • Subject: Crimes, Criminal Procedure and Corrections

The Story

It was introduced on January 6, 2021 and referred to the House Criminal Justice and Public Safety committee. The committee voted unanimously, 20–0, to recommend that the House pass it, and the report was placed on the consent calendar. It crossed to the Senate on April 1, 2021 and was referred to the Senate Judiciary committee. On April 7, 2021 the House voted to pass it on a voice vote. On April 7, 2021 the House failed “Reconsider” on a voice vote, on a motion by Rep. Jason Osborne. The committee recommended that the Senate kill it. On April 29, 2021 the Senate rejected a motion to kill it. A floor amendment (2021-1224s), offered by Sen. Sharon Carson, was adopted on a roll call 24–0 on April 29, 2021, changing the text of the bill. On April 29, 2021 the Senate voted to pass it with changes and ordered it to a third reading. On June 4, 2021 the House adopted “House Non-Concurs with Senate Amendment 2021-1224s and Requests CofC (Reps. Abbas, Rhodes, Wallace, Harriott-Gathright)” on a voice vote. On June 10, 2021 the Senate adopted “Accedes to House Request for Committee of Conference” on a voice vote, on a motion by Sen. Sharon Carson. A committee of conference met on June 16, 2021 to try to settle the differences between the two chambers' versions of the bill. On June 24, 2021 the Senate adopted the conference report (2021-2032c) on a voice vote. On June 24, 2021 the House adopted the conference report (2021-2032c) on a voice vote. The bill was enrolled on June 24, 2021 — the final check of the text before it goes to the governor. The governor vetoed it on August 10, 2021. The legislature can override a veto with a two-thirds vote in both chambers. On January 5, 2022 the House voted 35–312 on overriding the governor's veto on a roll call, and the veto was sustained, failing to meet the two thirds threshold.
