HB 349 (2019)
relative to a second opinion on health care matters for state and county prisoners.
- Status: Vetoed, override failed
- Term: 2019-2020
- House committee: Criminal Justice and Public Safety
- Senate committee: Judiciary
- Subject: Miscellaneous
The Story
It was introduced on January 2, 2019 and referred to the House Criminal Justice and Public Safety committee. The committee held a public hearing on January 9, 2019. The committee met in executive session on January 17, 2019 to vote on its recommendation. The minority of the committee recommended that the House kill it. The majority of the committee recommended that the House pass it by a vote of 15–5, and the report was placed on the regular calendar. On January 31, 2019 the House voted to pass it on a roll call 226–145. It crossed to the Senate on March 7, 2019 and was referred to the Senate Judiciary committee. The committee recommended that the Senate pass it with changes (amendment 2019-2328s). The committee's amendment (2019-2328s) was adopted on a voice vote on May 30, 2019, changing the text of the bill. On May 30, 2019 the Senate voted to pass it with changes on a voice vote and ordered it to a third reading. On June 13, 2019 the House adopted “House Concurs with Senate Amendment 2328s” on a voice vote, on a motion by Rep. Cushing. The bill was enrolled on June 27, 2019 — the final check of the text before it goes to the governor. The governor vetoed it on July 12, 2019. The legislature can override a veto with a two-thirds vote in both chambers. On September 18, 2019 the House voted 229–155 on overriding the governor's veto on a roll call, and the veto was sustained, failing to meet the two thirds threshold.
