HB 86 (2017)
relative to voting on variances.
- Status: Vetoed, override failed
- Term: 2017-2018
- House committee: Municipal and County Government
- Senate committee: Public and Municipal Affairs
- Subject: Zoning and Planning
The Story
It was introduced on January 4, 2017 and referred to the House Municipal and County Government committee. The committee held a public hearing on January 25, 2017. The committee met in executive session on January 25, 2017 to vote on its recommendation. The committee voted unanimously, 15–0, to recommend that the House pass it with changes (amendment 2017-0129h), and the report was placed on the consent calendar. The committee's amendment (2017-0129h) was adopted on a voice vote on February 9, 2017, changing the text of the bill. On February 9, 2017 the House voted to pass it with changes on a voice vote. It crossed to the Senate on February 16, 2017 and was referred to the Senate Public and Municipal Affairs committee. The committee held a public hearing on March 8, 2017. The committee recommended that the Senate pass it with changes (amendment 2017-1382s). The committee's amendment (2017-1382s) was adopted on a voice vote on April 20, 2017, changing the text of the bill. On April 20, 2017 the Senate voted to pass it with changes on a voice vote and ordered it to a third reading. On June 8, 2017 the House adopted “House Concurs with Senate Amendment 1382s” on a voice vote, on a motion by Rep. J. Belanger. The bill was enrolled on June 22, 2017 — the final check of the text before it goes to the governor. The governor vetoed it on July 10, 2017. The legislature can override a veto with a two-thirds vote in both chambers. On November 2, 2017 the House voted 115–164 on overriding the governor's veto on a roll call, and the veto was sustained, failing to meet the two thirds threshold.
