SB 336 (2016)

relative to the qualifications for obtaining a license to carry a concealed pistol or revolver.

  • Status: Vetoed, override failed
  • Term: 2015-2016
  • House committee: Criminal Justice and Public Safety
  • Senate committee: Judiciary
  • Subject: Crimes, Criminal Procedure and Corrections

The Story

It was introduced on January 6, 2016 and referred to the Senate Judiciary committee. The committee held a public hearing on March 14, 2016. The committee recommended that the Senate pass it with changes (amendment 2016-1046s). On March 24, 2016 the Senate adopted “Special Order SB 336 to After Lunch, Without Objection”. The committee's amendment (1046s) was adopted on a roll call 22–2 on March 24, 2016, changing the text of the bill. A floor amendment (2016-1150s), offered by Sen. Pierce, was rejected on a roll call 10–14 on March 24, 2016. On March 24, 2016 the Senate voted to pass it with changes and ordered it to a third reading. It crossed to the House and was referred to the House Criminal Justice and Public Safety committee. The committee held a public hearing on April 19, 2016. The committee met in executive session on April 26, 2016 to vote on its recommendation. The committee voted 11–7 to recommend that the House kill it, and the report was placed on the regular calendar. On May 11, 2016 the House rejected a motion to kill it on a roll call 156–189. A floor amendment (2016-1888h), offered by Rep. Hoell, was adopted on a voice vote on May 11, 2016, changing the text of the bill. On May 11, 2016 the House voted to pass it with changes on a roll call 217–132. On May 19, 2016 the Senate voted to agree to the other chamber's changes, on a motion by Sen. Sharon Carson. The bill was enrolled on June 1, 2016 — the final check of the text before it goes to the governor — and an enrolled bill amendment (2016-2121e) was adopted on a voice vote to correct technical errors found after passage. The governor vetoed it on June 16, 2016. The legislature can override a veto with a two-thirds vote in both chambers. On September 29, 2016 the Senate voted 13–9 on overriding the governor's veto on a roll call, and the veto was sustained, failing to meet the two thirds threshold.
