SB 320 (2016)

relative to non-academic surveys administered by a public school to its students.

  • Status: Vetoed, override failed
  • Term: 2015-2016
  • House committee: Education
  • Senate committee: Education
  • Subject: Education - General

The Story

It was introduced on January 6, 2016 and referred to the Senate Education committee. The committee held a public hearing on February 2, 2016. The committee recommended that the Senate pass it with changes (amendment 2016-0551s). The committee's amendment (0551s) was adopted on a voice vote on March 3, 2016, changing the text of the bill. On March 3, 2016 the Senate voted to pass it with changes and ordered it to a third reading. It crossed to the House on March 10, 2016 and was referred to the House Education committee. The committee held a public hearing on March 22, 2016. The committee met in executive session on March 29, 2016 to vote on its recommendation. The minority of the committee recommended that the House kill it. The majority of the committee recommended that the House pass it with changes (amendment 2016-1143h) by a vote of 11–9, and the report was placed on the regular calendar. The committee's amendment (2016-1143h) was adopted on a voice vote on April 6, 2016, changing the text of the bill. A floor amendment (2016-1240h), offered by Rep. Timothy Horrigan, was rejected on a roll call 52–274 on April 6, 2016. On April 6, 2016 the House voted to pass it with changes on a voice vote. On April 14, 2016 the Senate voted to reject the other chamber's changes on a voice vote, on a motion by Sen. Reagan. On May 11, 2016 the House adopted “House Accedes to Senate Request for CofC” on a voice vote, on a motion by Rep. Rick Ladd. A committee of conference met on May 19, 2016 to try to settle the differences between the two chambers' versions of the bill. On June 1, 2016 the House adopted the conference report (1988c) on a roll call 285–56. On June 1, 2016 the Senate adopted the conference report (1988c) on a roll call 14–10. The bill was enrolled on June 1, 2016 — the final check of the text before it goes to the governor. The governor vetoed it on June 21, 2016. The legislature can override a veto with a two-thirds vote in both chambers. On September 29, 2016 the Senate voted 13–9 on overriding the governor's veto on a roll call, and the veto was sustained, failing to meet the two thirds threshold.
