  • Status: Vetoed, override failed
  • Term: 2015-2016
  • House committee: Education
  • Senate committee: Education
  • Subject: Education - General

The Story

It was introduced on January 6, 2016 and referred to the House Education committee. The committee held a public hearing on February 12, 2016. The committee met in executive session on March 1, 2016 to vote on its recommendation. The minority of the committee recommended that the House kill it. The majority of the committee recommended that the House pass it with changes (amendment 2016-0878h) by a vote of 12–9, and the report was placed on the regular calendar. On March 10, 2016 the House adopted “Special Order to calendar of 3/23/2016” on a division vote 275–25. The committee's amendment (2016-0878h) was adopted on a voice vote on March 23, 2016, changing the text of the bill. On March 23, 2016 the House voted to pass it with changes on a division vote 208–143. It crossed to the Senate on March 24, 2016 and was referred to the Senate Education committee. The committee held a public hearing on April 12, 2016. The committee recommended that the Senate study it after the session ends. On April 28, 2016 the Senate adopted “Special Order HB 1637 to 05/05/2016, Without Objection”. The committee recommended that the Senate study it after the session ends. On May 5, 2016 the Senate failed “Refer to Interim Study” on a voice vote. A floor amendment (2016-1736s), offered by Sen. Reagan, was adopted on a voice vote on May 5, 2016, changing the text of the bill. On May 5, 2016 the Senate voted to pass it with changes and ordered it to a third reading. On May 19, 2016 the House adopted “House Non-Concurs with Senate Amendment 1736s and Requests CofC” on a division vote 178–137, on a motion by Rep. Rick Ladd. On May 19, 2016 the Senate adopted “Accedes to House Request for Committee of Conference” on a voice vote, on a motion by Sen. Reagan. A committee of conference met on May 24, 2016 and May 25, 2016 to try to settle the differences between the two chambers' versions of the bill. On June 1, 2016 the Senate adopted the conference report (2093c) on a roll call 14–10. On June 1, 2016 the House adopted the conference report (2093c) on a roll call 190–132. The bill was enrolled on June 1, 2016 — the final check of the text before it goes to the governor — and an enrolled bill amendment (2016-2135e) was adopted on a voice vote to correct technical errors found after passage. The governor vetoed it on June 9, 2016. The legislature can override a veto with a two-thirds vote in both chambers. On June 16, 2016 the House voted 147–105 on overriding the governor's veto on a roll call, and the veto was sustained, failing to meet the two thirds threshold.
