SB 169 (2015)
relative to permissible uses of electronic benefit transfer (EBT) cards.
- Status: Vetoed, override failed
- Term: 2015-2016
- House committee: Health, Human Services and Elderly Affairs
- Senate committee: Health and Human Services
- Subject: Welfare/Medicare/Medicaid
The Story
It was introduced on January 8, 2015 and referred to the Senate Health and Human Services committee. The committee held a public hearing on March 10, 2015. The committee recommended that the Senate pass it. A floor amendment (2015-1137s), offered by Sen. Fuller Clark, was rejected on a roll call 10–13 on March 26, 2015. A floor amendment (2015-1148s), offered by Sen. Feltes, was rejected on a roll call 10–13 on March 26, 2015. On March 26, 2015 the Senate adopted “Reconsideration of vote on Floor Amendment 1148s” on a voice vote, on a motion by Sen. Bradley. A floor amendment (2015-1148s), offered by Sen. Feltes, was rejected on a roll call 9–14 on March 26, 2015. On March 26, 2015 the Senate voted to pass it on a roll call 19–4 and ordered it to a third reading. It crossed to the House and was referred to the House Health, Human Services and Elderly Affairs committee. The committee held a public hearing on April 8, 2015. The committee met in executive session on April 28, 2015 and May 19, 2015. The committee voted unanimously, 17–0, to recommend that the House pass it with changes (amendment 2015-1724h), and the report was placed on the consent calendar. The committee's amendment (1724h) was adopted on a voice vote on June 3, 2015, changing the text of the bill. On June 3, 2015 the House voted to pass it with changes on a voice vote. On June 3, 2015 the House adopted “House Accedes to Senate Request for Committee of Conference (Rep Hinch)” on a voice vote. On June 4, 2015 the Senate voted to reject the other chamber's changes on a voice vote, on a motion by Sen. Sanborn. A committee of conference met on June 17, 2015 to try to settle the differences between the two chambers' versions of the bill. The House adopted the conference report (2310c) on a roll call 213–143. The Senate adopted the conference report (2310c) on a voice vote. The bill was enrolled on June 24, 2015 — the final check of the text before it goes to the governor. The governor vetoed it on July 10, 2015. The legislature can override a veto with a two-thirds vote in both chambers. On September 16, 2015 the Senate voted 14–10 on overriding the governor's veto on a roll call, and the veto was sustained, failing to meet the two thirds threshold.
