HB 422 (2014)

relative to the adoption, revision, and amendment of municipal charters.

  • Status: Signed into law
  • Term: 2013-2014
  • House committee: Municipal and County Government
  • Senate committee: Public and Municipal Affairs
  • Subject: Municipalities
  • Chapter law: 292

The Story

It was introduced on January 3, 2013 and referred to the House Municipal and County Government committee. The committee held a public hearing on February 7, 2013. The committee met in executive session on February 21, 2013 to vote on its recommendation. The committee retained the bill, holding it for further work rather than reporting it out this year. The committee held work sessions on May 7, 2013, June 11, 2013, September 10, 2013, October 10, 2013 and November 12, 2013. The committee met in executive session on November 12, 2013 to vote on its recommendation. The committee voted unanimously, 15–0, to recommend that the House pass it with changes (amendment 2013-2251h), and the report was placed on the consent calendar. The committee's amendment (2251h) was adopted on a voice vote on January 8, 2014, changing the text of the bill. On January 8, 2014 the House voted to pass it with changes on a voice vote. It crossed to the Senate on February 19, 2014 and was referred to the Senate Public and Municipal Affairs committee. The committee held a public hearing on April 16, 2014. The committee voted unanimously, 5–0, to recommend that the Senate pass it with changes (amendment 2014-1439s), and the report was placed on the consent calendar. The bill was taken off the consent calendar on April 24, 2014. On April 24, 2014 the Senate rejected a motion to lay it on the table on a roll call 7–16, on a motion by Sen. Pierce. The committee's amendment (1439s) was adopted on a voice vote on April 24, 2014, changing the text of the bill. Sen. Boutin proposed a floor amendment (2014-1550s) on April 24, 2014; it was later withdrawn. On April 24, 2014 the Senate adopted “Special Order HB 422 to the end of the Calendar, Without Objection”. A floor amendment (2014-1555s), offered by Sen. Boutin, was adopted on a voice vote on April 24, 2014, changing the text of the bill. On April 24, 2014 the Senate voted to pass it with changes on a roll call 15–7 and ordered it to a third reading. On May 14, 2014 the House rejected a motion to agree to the other chamber's changes on a roll call 164–171. On May 14, 2014 the House adopted “Non-Concur and Request C of C (Rep Porter)” on a division vote 312–24. On May 22, 2014 the Senate adopted “Accedes to House Request for Committee of Conference” on a voice vote, on a motion by Sen. Boutin. A committee of conference met on May 27, 2014 and May 29, 2014 to try to settle the differences between the two chambers' versions of the bill. The Senate adopted the conference report (1998c) on a voice vote. The House adopted the conference report (1998c) on a division vote 328–13. An enrolled bill amendment (2028e) was adopted on June 4, 2014. These correct technical errors found after passage. The bill was enrolled on June 25, 2014 — the final check of the text before it goes to the governor — and an enrolled bill amendment (2014-2028eba) was adopted on a voice vote to correct technical errors found after passage. The governor signed it on August 1, 2014, making it Chapter 292 of the session laws.
