SB 480 (2010)

relative to appeals of decisions by the department of environmental services.

  • Status: Signed into law
  • Term: 2009-2010
  • House committee: Judiciary
  • Senate committee: Energy, Environment and Economic Development
  • Subject: Environment - Administration
  • Chapter law: 354

The Story

It was introduced on January 21, 2010 and referred to the Senate Energy, Environment and Economic Development committee. The committee held a public hearing on February 4, 2010. The committee recommended that the Senate pass it with changes. The committee's amendment (1106s) was adopted on a voice vote on March 24, 2010, changing the text of the bill. On March 24, 2010 the Senate voted to pass it with changes on a voice vote and ordered it to a third reading. It crossed to the House on March 24, 2010 and was referred to the House Judiciary committee. The committee held a public hearing on April 6, 2010. The committee held work sessions on April 15, 2010, April 22, 2010, April 27, 2010 and April 29, 2010. The committee met in executive session on April 29, 2010 to vote on its recommendation. The minority of the committee recommended that the House kill it. A floor amendment (1737h) was adopted on a voice vote on May 13, 2010, changing the text of the bill. A floor amendment (2052h) was rejected on a roll call 144–179 on May 13, 2010. On May 13, 2010 the House voted to pass it on a division vote 199–125. On May 19, 2010 the Senate voted to reject the other chamber's changes on a voice vote, on a motion by Sen. Fuller Clark. On May 19, 2010 the House adopted “House Accedes to Request for Comm of Conf (Rep Hess)” on a voice vote. A committee of conference met on May 24, 2010, May 25, 2010 and May 26, 2010 to try to settle the differences between the two chambers' versions of the bill. The bill was enrolled on June 2, 2010 — the final check of the text before it goes to the governor — and an enrolled bill amendment (2424) was adopted to correct technical errors found after passage. The governor signed it on July 20, 2010, making it Chapter 354 of the session laws.
