HB 379 (2010)
exempting certain meetings concerning collective bargaining from the right-to-know law.
- Status: Vetoed, override failed
- Term: 2009-2010
- House committee: Judiciary
- Senate committee: Public and Municipal Affairs
- Subject: Right to Know
The Story
It was introduced on January 8, 2009 and referred to the House Judiciary committee. The committee held a public hearing on January 29, 2009. The committee held a work session on March 5, 2009. The committee met in executive session on March 17, 2009 to vote on its recommendation. The committee retained the bill, holding it for further work rather than reporting it out this year. The committee held a work session on November 17, 2009. The committee met in executive session on November 17, 2009 to vote on its recommendation. The majority recommended that the House pass it with changes (amendment 2390h), and the minority recommended that the House kill it, by a vote of 11–8. The committee's amendment (2390h) was adopted on a division vote 187–127 on January 13, 2010, changing the text of the bill. On January 13, 2010 the House voted to pass it with changes on a roll call 199–141. It crossed to the Senate on March 24, 2010 and was referred to the Senate Public and Municipal Affairs committee. The committee held a public hearing on May 6, 2010. The committee recommended that the Senate pass it. On May 12, 2010 the Senate voted to pass it on a voice vote and ordered it to a third reading. The bill was enrolled on May 19, 2010 — the final check of the text before it goes to the governor — and an enrolled bill amendment (2102) was adopted to correct technical errors found after passage. The governor vetoed it on July 26, 2010. The legislature can override a veto with a two-thirds vote in both chambers. On October 13, 2010 the House voted 55–279 on overriding the governor's veto on a roll call, and the veto was sustained, failing to meet the two thirds threshold.
