  • Status: Vetoed, override failed
  • Term: 2009-2010
  • House committee: Election Law
  • Senate committee: Election Law and Veterans' Affairs
  • Subject: Elections

The Story

It was introduced on January 8, 2009 and referred to the House Election Law committee. The committee held a public hearing on January 27, 2009. The committee met in executive session on February 3, 2009 to vote on its recommendation. The committee voted unanimously, 16–0, to recommend that the House pass it (amendment 0132h). On February 12, 2009 the House adopted “Special Ordered to Follow First Bill on Regular Calendar for Feb 18” on a voice vote. The committee's amendment (0132h) was adopted on a voice vote on February 18, 2009, changing the text of the bill. On February 18, 2009 the House voted to pass it with changes on a roll call 256–114. On February 18, 2009 the bill was referred to the Criminal Justice and Public Safety committee. The committee held a public hearing on March 31, 2009. The committee met in executive session on April 2, 2009 to vote on its recommendation. The committee voted 19–1 to recommend that the House pass it with changes (amendment 1193h). The committee's amendment (1193h) was adopted on a voice vote on April 8, 2009, changing the text of the bill. On April 8, 2009 the House voted to pass it with changes on a voice vote. It crossed to the Senate on April 8, 2009 and was referred to the Senate Election Law and Veterans' Affairs committee. The committee held a public hearing on April 28, 2009. The committee recommended that the Senate send it back to committee. On May 13, 2009 the Senate voted to send it back to committee on a voice vote. The committee recommended that the Senate pass it. A floor amendment (0223s), offered by Sen. Sharon Carson, was rejected on a roll call 9–14 on January 21, 2010. On January 21, 2010 the Senate voted to pass it on a roll call 14–9 and ordered it to a third reading. The bill was enrolled on February 4, 2010 — the final check of the text before it goes to the governor. The governor vetoed it on February 12, 2010. The legislature can override a veto with a two-thirds vote in both chambers. On May 19, 2010 the House failed “Notwithstanding Gov's Veto Shall HB276 Become Law (Rep W.O'Brien)” on a roll call 1–327. On May 19, 2010 the House voted on overriding the governor's veto, and the veto was sustained, failing to meet the two thirds threshold.
