HB 219 (2010)

relative to hearings for incapacitated persons admitted to state institutions by their guardians.

  • Status: Signed into law
  • Term: 2009-2010
  • House committee: Judiciary
  • Senate committee: Judiciary
  • Subject: Miscellaneous
  • Chapter law: 288

The Story

It was introduced on January 7, 2009 and referred to the House Judiciary committee. The committee held a public hearing on February 19, 2009. The committee met in executive session on March 9, 2009 to vote on its recommendation. The committee retained the bill, holding it for further work rather than reporting it out this year. The committee held work sessions on October 6, 2009, November 3, 2009 and November 17, 2009. The committee met in executive session on November 17, 2009 to vote on its recommendation. The majority recommended that the House pass it with changes (amendment 2490h), and the minority recommended that the House kill it, by a vote of 13–6. The committee's amendment (2490h) was adopted on a voice vote on January 13, 2010, changing the text of the bill. On January 13, 2010 the House voted to pass it with changes on a voice vote. It crossed to the Senate on March 24, 2010 and was referred to the Senate Judiciary committee. The committee held a public hearing on April 27, 2010. The committee recommended that the Senate pass it with changes. The committee's amendment (1738s) was adopted on a voice vote on May 5, 2010, changing the text of the bill. On May 5, 2010 the Senate voted to pass it with changes on a voice vote and ordered it to a third reading. On May 19, 2010 the House adopted “House Concurs with Senate AM #1738s (Rep Cote)” on a voice vote. The bill was enrolled on June 2, 2010 — the final check of the text before it goes to the governor. The governor signed it on July 13, 2010, making it Chapter 288 of the session laws.
