HB 1161 (2010)

repealing the requirement to obtain a license to sell in order to sell pistols or revolvers at retail.

  • Status: Vetoed, override failed
  • Term: 2009-2010
  • House committee: Criminal Justice and Public Safety
  • Senate committee: Judiciary
  • Subject: Miscellaneous

The Story

It was introduced on January 6, 2010 and referred to the House Criminal Justice and Public Safety committee. The committee held a public hearing on January 19, 2010. The committee met in executive session on February 2, 2010 to vote on its recommendation. The committee voted unanimously, 17–0, to recommend that the House pass it with changes (amendment 0190h). The committee's amendment (0190h) was adopted on a voice vote on February 17, 2010, changing the text of the bill. On February 17, 2010 the House voted to pass it with changes on a voice vote. It crossed to the Senate on March 3, 2010 and was referred to the Senate Judiciary committee. The committee held a public hearing on March 23, 2010. The committee recommended that the Senate pass it. On April 28, 2010 the Senate voted to pass it on a voice vote and ordered it to a third reading. The bill was enrolled on May 12, 2010 — the final check of the text before it goes to the governor. The governor vetoed it on July 26, 2010. The legislature can override a veto with a two-thirds vote in both chambers. On October 13, 2010 the House voted 266–69 to override the governor's veto on a roll call, meeting the two thirds threshold. On October 13, 2010 the Senate voted 15–8 on overriding the governor's veto on a roll call, and the veto was sustained, failing to meet the two thirds threshold.
