SB 109 (2007)

relative to emergency powers of the supreme court.

  • Status: Vetoed, override failed
  • Term: 2007-2008
  • House committee: Judiciary
  • Senate committee: Judiciary
  • Subject: Miscellaneous

The Story

It was introduced on January 4, 2007 and referred to the Senate Judiciary committee. The committee held a public hearing on February 20, 2007. The committee recommended that the Senate pass it. On March 8, 2007 the Senate adopted “Sen Reynolds Moved Laid On Table” on a voice vote. On April 12, 2007 the Senate adopted “Remove From Table” on a voice vote, on a motion by Sen. Foster. A floor amendment (1209), offered by Sen. Foster, was adopted on a voice vote on April 12, 2007, changing the text of the bill. On April 12, 2007 the Senate voted to pass it with changes on a voice vote and ordered it to a third reading. It crossed to the House and was referred to the House Judiciary committee. The committee held a public hearing on May 1, 2007. The committee held work sessions on May 15, 2007 and May 22, 2007. The committee met in executive session on May 23, 2007 to vote on its recommendation. The committee voted unanimously, 18–0, to recommend that the House pass it with changes, and the report was placed on the consent calendar. The committee's amendment (1764h) was adopted on a voice vote on May 31, 2007, changing the text of the bill. On May 31, 2007 the House voted to pass it with changes on a voice vote. On June 13, 2007 the Senate adopted “Sen. Foster Concurs with House Amendment{1764}” on a voice vote. The bill was enrolled on June 27, 2007 — the final check of the text before it goes to the governor. The governor vetoed it on July 19, 2007. The legislature can override a veto with a two-thirds vote in both chambers. On September 5, 2007 the Senate voted on overriding the governor's veto, and the veto was sustained, failing to meet the two thirds threshold.
