HB 143 (2007)

relative to the apportionment of damages in civil actions.

  • Status: Vetoed, override failed
  • Term: 2007-2008
  • House committee: Judiciary
  • Senate committee: Judiciary
  • Subject: Civil Actions

The Story

It was introduced on January 4, 2007 and referred to the House Judiciary committee. The committee held a public hearing on January 30, 2007. The committee met in executive session on February 13, 2007 to vote on its recommendation. The committee voted 17–1 to recommend that the House pass it, and the report was placed on the consent calendar. The bill was taken off the consent calendar on February 16, 2007. On February 21, 2007 the House failed “Recommit (Rep Hunt)” on a roll call 164–199. On February 21, 2007 the House voted to pass it on a roll call 202–150. It crossed to the Senate on March 22, 2007 and was referred to the Senate Judiciary committee. The committee held a public hearing on May 22, 2007. The committee recommended that the Senate pass it. On May 31, 2007 the Senate voted to lay it on the table on a roll call 15–8, on a motion by Sen. Gottesman. On June 7, 2007 the Senate adopted “Remove From Table” on a voice vote, on a motion by Sen. Gottesman. A floor amendment (2086), offered by Sen. Burling, was adopted on a roll call 13–10 on June 7, 2007, changing the text of the bill. On June 7, 2007 the Senate voted to pass it with changes on a roll call 12–11 and ordered it to a third reading. On June 13, 2007 the House rejected a motion to lay it on the table on a roll call 143–192. On June 13, 2007 the House adopted “Move Previous Question (Rep J.Flanders)” on a voice vote. On June 13, 2007 the House adopted “House Concurs with Senate AM #2086s, Rep Wall” on a division vote 182–153. The bill was enrolled on June 14, 2007 — the final check of the text before it goes to the governor. The governor vetoed it on July 5, 2007. The legislature can override a veto with a two-thirds vote in both chambers. On September 5, 2007 the House voted 65–254 on overriding the governor's veto on a roll call, and the veto was sustained, failing to meet the two thirds threshold.
