SB 318-FN (2006)
relative to the use of deadly force to protect oneself.
- Status: Vetoed, override failed
- Term: 2005-2006
- House committee: Criminal Justice and Public Safety
- Senate committee: Judiciary
- Subject: Crimes, Criminal Procedure and Corrections
The Story
It was introduced on January 4, 2006 and referred to the Senate Judiciary committee. The committee held a public hearing on January 19, 2006. The committee recommended that the Senate kill it. On February 23, 2006 the Senate adopted “Special Order To 03/09/06” on a voice vote, on a motion by Sen. Clegg. On March 9, 2006 the Senate rejected a motion to kill it on a roll call 11–12. On March 9, 2006 the Senate voted to pass it on a voice vote and ordered it to a third reading. On March 9, 2006 the Senate voted to pass it. It crossed to the House on March 22, 2006 and was referred to the House Criminal Justice and Public Safety committee. The committee held a public hearing on March 29, 2006. The majority recommended that the House kill it, and the minority recommended that the House pass it, by a vote of 9–5. On April 26, 2006 the House rejected a motion to kill it on a roll call 147–178. On April 26, 2006 the House voted to pass it on a roll call 193–134. On April 26, 2006 the House failed “Reconsideration” on a voice vote. The bill was enrolled on May 10, 2006 — the final check of the text before it goes to the governor. The governor vetoed it on May 12, 2006. The legislature can override a veto with a two-thirds vote in both chambers. On June 28, 2006 the Senate voted 11–11 on overriding the governor's veto on a roll call, and the veto was sustained, failing to meet the two thirds threshold.
