It was introduced on January 26, 2005 and referred to the House Criminal Justice and Public Safety committee. The committee held a public hearing on February 23, 2005. The committee voted 14–2 to recommend that the House pass it with changes, and the report was placed on the consent calendar. On March 30, 2005 the House voted to pass it with changes. It crossed to the Senate on March 31, 2005 and was referred to the Senate Judiciary committee. The committee held a public hearing on April 21, 2005. The committee recommended that the Senate pass it with changes (amendment 1747). The committee's amendment (1747) was adopted on a voice vote on June 9, 2005, changing the text of the bill. On June 15, 2005 the House voted to reject the other chamber's changes on a voice vote. On June 16, 2005 the Senate adopted “Sen. Foster Accede to House Request for Committee of Conference” on a voice vote. A committee of conference met on June 21, 2005 to try to settle the differences between the two chambers' versions of the bill. It took effect on January 1, 2006.
