HB 2004-FN-LOCAL (2004)

relative to the state 10-year transportation improvement plan and making certain adjustments to turnpike funds.

  • Status: Veto overridden, became law
  • Term: 2003-2004
  • House committee: Public Works and Highways
  • Senate committee: Capital Budget
  • Subject: Transportation and Highways
  • Chapter law: 262

The Story

It was introduced on January 22, 2004 and referred to the House Public Works and Highways committee. The committee held public hearings on February 3, 2004, February 4, 2004 and February 11, 2004. The committee met in executive session on February 12, 2004 to vote on its recommendation. The majority recommended that the House pass it with changes, and the minority recommended that the House kill it, by a vote of 16–1. On March 11, 2004 the House voted to pass it with changes on a voice vote. It crossed to the Senate on March 17, 2004 and was referred to the Senate Transportation committee. On April 8, 2004 the Senate adopted “Vacate HB 2004 From Transportation to Capital Budget” on a voice vote, on a motion by Sen. Kenney. The committee held a public hearing on April 20, 2004. The committee recommended that the Senate pass it with changes (amendment 1387). The committee's amendment (1387) was adopted on a voice vote on May 6, 2004, changing the text of the bill. A floor amendment (1496), offered by Sen. Larsen, was rejected on a roll call 6–17 on May 6, 2004. On May 6, 2004 the Senate voted to pass it. On May 13, 2004 the House voted to reject the other chamber's changes on a voice vote. On May 13, 2004 the Senate adopted “Accede to House Request for C of C”, on a motion by Sen. Kenney. A committee of conference met on May 17, 2004, May 18, 2004 and May 19, 2004 to try to settle the differences between the two chambers' versions of the bill. On May 25, 2004 the Senate adopted “Conference Committee Report” on a voice vote. On May 25, 2004 the House adopted “Susp Rules for new Conf Comm” on a voice vote. On May 25, 2004 the Senate adopted “Rules Susp.2/3nec.to Permit Body to Act on Report of New C of C after Deadline” on a voice vote. On May 25, 2004 the Senate voted to pass it. The bill was enrolled on May 25, 2004 — the final check of the text before it goes to the governor — and an enrolled bill amendment (1704) was adopted to correct technical errors found after passage. The governor vetoed it on June 15, 2004. The legislature can override a veto with a two-thirds vote in both chambers. On June 17, 2004 the House voted 312–31 to override the governor's veto on a roll call, meeting the two thirds threshold. On June 17, 2004 the Senate voted 23–1 to override the governor's veto on a roll call, meeting the two thirds threshold. It became law over the governor's veto on June 17, 2004, as Chapter 262. The governor had vetoed it, and the House and the Senate each overrode the veto by a two-thirds vote, which under Part II, Article 44 of the state constitution makes it law without the governor's signature.
