HB 1134 (2004)

relative to appointment of the chief justice of the supreme court.

  • Status: Vetoed, override failed
  • Term: 2003-2004
  • House committee: Judiciary
  • Senate committee: Executive Departments and Administration
  • Subject: Miscellaneous

The Story

It was introduced on September 4, 2003 and referred to the House Judiciary committee. The committee held a public hearing on January 13, 2004. The majority recommended that the House pass it with changes, and the minority recommended that the House study it after the session ends, by a vote of 8–7. On March 11, 2004 the House voted to pass it with changes on a roll call 216–135. It crossed to the Senate on March 17, 2004 and was referred to the Senate Executive Departments and Administration committee. The committee held a public hearing on March 31, 2004. The committee recommended that the Senate pass it. On April 22, 2004 the Senate rejected a motion to lay it on the table. On April 22, 2004 the Senate voted to pass it and ordered it to a third reading. On April 22, 2004 the Senate voted to pass it. The bill was enrolled on April 29, 2004 — the final check of the text before it goes to the governor. The governor vetoed it on May 10, 2004. The legislature can override a veto with a two-thirds vote in both chambers. On June 17, 2004 the House voted 153–190 on overriding the governor's veto on a roll call, and the veto was sustained, failing to meet the two thirds threshold.
