It was introduced on January 30, 2003 and referred to the Senate Environment committee. The committee held a public hearing on March 5, 2003. The committee recommended that the Senate pass it with changes (amendment 0595). The committee's amendment (0595) was adopted on a voice vote on March 13, 2003, changing the text of the bill. On March 13, 2003 the Senate voted to pass it with changes on a voice vote and ordered it to a third reading. On March 13, 2003 the Senate voted to pass it. It crossed to the House on March 13, 2003 and was referred to the House Resources, Recreation and Development committee. The committee held a public hearing on April 2, 2003. The committee held work sessions on April 9, 2003, April 16, 2003, May 7, 2003 and May 14, 2003. The majority recommended that the House pass it with changes, and the minority recommended that the House pass it, by a vote of 14–1. On June 24, 2003 the Senate adopted “Conference Committee Report” on a voice vote. The bill was enrolled on June 30, 2003 — the final check of the text before it goes to the governor — and an enrolled bill amendment (2303) was adopted on a voice vote to correct technical errors found after passage. The governor signed it on July 18, 2003, making it Chapter 305 of the session laws. It took effect on July 18, 2003.
