HB 738 (2001)

establishing a commission to assess the operating efficiency of state government.

  • Status: Vetoed, override failed
  • Term: 2001-2002
  • House committee: Executive Departments and Administration
  • Senate committee: Internal Affairs
  • Subject: Miscellaneous

The Story

It was introduced on February 15, 2001 and referred to the House Executive Departments and Administration committee. The committee held a public hearing on March 21, 2001. The committee held work sessions on April 3, 2001 and April 10, 2001. The majority of the committee recommended that the House pass it with changes unanimously, 17–0, and the report was placed on the consent calendar. On April 18, 2001 the House voted to pass it with changes. It crossed to the Senate on May 1, 2001 and was referred to the Senate Internal Affairs committee. The committee held a public hearing on May 8, 2001. The committee reported: Split Report. On June 5, 2001 the Senate rejected a motion to lay it on the table. On June 5, 2001 the Senate failed “Recommit” on a roll call 11–13, on a motion by Sen. Pignatelli. On June 5, 2001 the Senate voted to send it back to committee on a voice vote. The committee recommended that the Senate pass it. A floor amendment (1639), offered by Sen. Flanders, was adopted on a voice vote on June 12, 2001, changing the text of the bill. On June 12, 2001 the Senate adopted “RC” and ordered it to a third reading. On June 12, 2001 the Senate adopted “Sen. Flanders Accede to House Request for Committee of Conference” on a voice vote. On June 13, 2001 the House voted to reject the other chamber's changes. A committee of conference met on June 20, 2001 to try to settle the differences between the two chambers' versions of the bill. On June 26, 2001 the Senate adopted “Conference Committee Report” on a voice vote. On June 26, 2001 the House adopted “Conf Comm Report”. The bill was enrolled on June 26, 2001 — the final check of the text before it goes to the governor — and an enrolled bill amendment (1871) was adopted to correct technical errors found after passage. The governor vetoed it on July 12, 2001. The legislature can override a veto with a two-thirds vote in both chambers. On December 12, 2001 the House voted 226–147 on overriding the governor's veto on a roll call, and the veto was sustained, failing to meet the two thirds threshold.
