It was introduced on January 4, 2001 and referred to the House Health, Human Services and Elderly Affairs committee. The committee held a public hearing on January 24, 2001. The majority of the committee recommended that the House pass it unanimously, 16–0, and the report was placed on the consent calendar. On February 15, 2001 the House voted to pass it. It crossed to the Senate on February 15, 2001 and was referred to the Senate Public Institutions, Health and Human Services committee. The committee held a public hearing on March 20, 2001. The committee recommended that the Senate pass it. On March 29, 2001 the Senate voted to pass it on a voice vote and ordered it to a third reading. The bill was enrolled on April 5, 2001 — the final check of the text before it goes to the governor. The governor signed it on April 23, 2001, making it Chapter 10 of the session laws. It took effect on June 22, 2001.
