SB 758-FN (1994)

relative to a civil filing fee surcharge for civil legal assistance to low-income persons.

  • Status: Vetoed, override failed
  • Term: 1993-1994
  • House committee: Judiciary
  • Senate committee: Judiciary
  • Subject: Miscellaneous

The Story

It was introduced on January 5, 1994 and referred to the Senate Judiciary committee. The committee held a public hearing on January 31, 1994. The majority recommended that the Senate pass it with changes, and the minority recommended that the Senate kill it. On February 16, 1994 the Senate voted to pass it with changes on a roll call 14–9. It crossed to the House on February 17, 1994 and was referred to the House Judiciary committee. The committee held a public hearing on March 9, 1994. The majority of the committee recommended that the House pass it with changes by a vote of 17–1. On March 31, 1994 the House voted to pass it with changes on a roll call 229–119, then referred it on to the House Appropriations committee. The committee held a public hearing on April 6, 1994. The majority of the committee recommended that the House pass it with changes unanimously, 19–0. On May 11, 1994 the House voted to pass it with changes on a roll call 212–127. On May 17, 1994 the Senate voted to reject the other chamber's changes on a voice vote. On May 17, 1994 the House adopted “Accede to Request for Committee of Conference” on a voice vote. On May 26, 1994 the House adopted “Conference Committee Report” on a voice vote. On May 26, 1994 the Senate adopted “Conference Committee Report” on a voice vote. The bill was enrolled on May 26, 1994 — the final check of the text before it goes to the governor. The governor vetoed it on June 8, 1994. The legislature can override a veto with a two-thirds vote in both chambers. On June 22, 1994 the Senate voted 13–10 on overriding the governor's veto on a roll call, and the veto was sustained, failing to meet the two thirds threshold.
