Kristin Noble", "committee": "Education Policy and Administration", "vote_yeas": 10, "vote_nays": 8, "text": "This bill as amended fundamentally reforms New Hampshire's home education framework under RSA 193-A by replacing outdated regulatory structures with a streamlined, parent-centered approach. It affirms the natural right of parents to direct their child's education, regardless of the child's ability, disability, or needs. Current law imposes moderate requirements that many families view as intrusive and unnecessary for successful home education. The bill shifts to a low-regulation model, placing New Hampshire among the freest states for homeschooling by eliminating burdensome requirements such as mandatory notifications, record-keeping, portfolios, annual evaluations, and state oversight for non-publicly funded home education programs. Provisions addressing privacy, data exclusion, warrant requirements for inspections and liability for bad-faith reports, protect home educating families from unwarranted government intrusion or discrimination. This bill as amended removes education as a factor in child neglect definitions and welfare assessments under RSA 169-C, focusing investigations on genuine evidence of abuse or neglect rather than educational method. The bill also clarifies distinctions between independent home education and publicly funded homeschooling in the Education Freedom Account pathway, while preserving access to public programs. The majority of the committee supports the bill as amended because it advances core principles of parental rights, educational freedom, and limited government intervention in family decisions."}, {"side": "Minority", "author": "Rep. Megan Murray", "committee": "Education Policy and Administration", "text": "The minority of the committee holds the position that this bill makes broad sweeping changes not only to certain programs under which the Education Freedom Accounts and Home Educated learning pathways seek access to resources, it becomes clear that public districts end up sharing the cost of those. Additionally, throughout the bill, there are a myriad of definitions that have been changed that fundamentally stand in direct opposition to the ability to have consistency and clarity for the Department of Education, risking potential federal and state legal liability as a result of such changes. Even changing the definition of the word \"child\" has negative consequences to education and certainly other departments, federal, and state law. \"Child\" is defined elsewhere in statute as: any person who has not reached his eighteenth birthday. This change alone may eliminate and prevent access to programs and services families are entitled to seek access to. There are changes that charge superintendents with working with home educated families to meet their goals, but in the same paragraph, set out a series of limitations that could create conflict in how a superintendent could interact with home education families. Additionally, there are serious conflicts within the bill that could limit the state's ability to comply with the Individuals with Disabilities Education Act (IDEA) and its understanding of a child's needs, because notification becomes optional, thus limiting the ability for the child find program to successfully work, comply and identify children who may require services. Furthermore, in creating an optional waiver, it would become next to impossible for districts to plan to set aside an appropriate amount of funding, set budgets, seek federal or state grants around disability services creating an unfunded mandate in that respect. It already takes districts approximately 18 months in arrears to receive funding reimbursement for special education service costs. Such a change would disenfranchise students needing those services while putting millions of dollars, compliance, and access to services at risk as a result. The tax burden at the local level would undoubtedly rise as a result of a loss of vital funding. For these reasons and many more the minority of the committee recommends this bill Inexpedient to Legislate, as we believe that it creates financial and structural harm to education and special education frameworks and services."}], "source": "House Calendar 10, 2026", "date": "2026-03-02", "dated": "signed", "cite": "HC 10", "cite_url": "https://gc.nh.gov/house/calendars_journals/viewer.aspx?fileName=calendars%5C2026%5CNo10%20March%206%202026.pdf"}, {"bill": "HB1268", "body": "S", "title": "AN ACT modifying the structure and administration of home education programs.", "source": "Senate committee report, released 2026-04-29", "date": "2026-05-07", "dated": "signed", "calendar": "Regular Calendar", "majority_recommendation": "OUGHT TO PASS WITH AMENDMENT", "minority_recommendation": "", "reports": [{"side": "Committee", "author": "Senator Daryl Abbas", "committee": "Education", "vote_yeas": 3, "vote_nays": 2, "amendment": "2026-1737s", "text": ""}], "cite": "SC 17", "cite_url": "https://gc.nh.gov/senate/calendars_journals/viewer.aspx?fileName=Calendars%5C2026%5CNo%2017%20April%2030%202026.pdf"}], "docket_reports": [], "report_actions": [], "veto_message": null, "bill_note": null, "subject": "Education - General", "subject_source": "general court", "house_committee": "Education Policy and Administration", "senate_committee": "Education", "lsr": "2026-2511", "docket_url": "https://gc.nh.gov/bill_status/legacy/bs2016/bill_docket.aspx?lsr=2511&sy=2026&txtsessionyear=2026&txtbillnumber=hb1268&sortoption=billnumber", "documents": [{"label": "Bill text", "url": "https://gc.nh.gov/bill_status/legacy/bs2016/billText.aspx?id=1715&txtFormat=html&sy=2026", "kind": "text"}, {"label": "Bill status page", "url": "https://gc.nh.gov/bill_status/legacy/bs2016/Bill_status.aspx?lsr=2511&sy=2026&txtsessionyear=2026&txtbillnumber=hb1268&sortoption=billnumber", "kind": "status"}, {"label": "Docket", "url": "https://gc.nh.gov/bill_status/legacy/bs2016/bill_docket.aspx?lsr=2511&sy=2026&txtsessionyear=2026&txtbillnumber=hb1268&sortoption=billnumber", "kind": "docket"}, {"label": "HJ 1, page 13", "url": "https://gc.nh.gov/house/calendars_journals/viewer.aspx?fileName=journals%5C2026%5CHJ%2001%20January%207%2C%202026.pdf", "kind": "record"}, {"label": "HC 10, page 36", "url": "https://gc.nh.gov/house/calendars_journals/viewer.aspx?fileName=calendars%5C2026%5CNo10%20March%206%202026.pdf", "kind": "record"}, {"label": "HJ 7, pages 122, 126 and 129", "url": "https://gc.nh.gov/house/calendars_journals/viewer.aspx?fileName=journals%5C2026%5CHJ%2007%20March%2011%2C%202026.pdf", "kind": "record"}, {"label": "SJ 7", "url": "https://gc.nh.gov/senate/calendars_journals/Journals/2026/SJ%2007%20March%2026%2C%202026.PDF", "kind": "record"}, {"label": "SC 15", "url": "https://gc.nh.gov/senate/calendars_journals/viewer.aspx?fileName=Calendars%5C2026%5CNo%2015%20April%2016%202026.pdf", "kind": "record"}, {"label": "SC 17", "url": "https://gc.nh.gov/senate/calendars_journals/viewer.aspx?fileName=Calendars%5C2026%5CNo%2017%20April%2030%202026.pdf", "kind": "record"}, {"label": "SJ 11", "url": "https://gc.nh.gov/senate/calendars_journals/Journals/2026/SJ%2011%20May%207%2C%202026.PDF", "kind": "record"}, {"label": "HJ 14, page 5", "url": "https://gc.nh.gov/house/calendars_journals/viewer.aspx?fileName=journals%5C2026%5CHJ%2014%20May%2021%2C%202026.pdf", "kind": "record"}, {"label": "SJ 14", "url": "https://gc.nh.gov/senate/calendars_journals/Journals/2026/SJ%2014%20June%204%2C%202026.PDF", "kind": "record"}, {"label": "HJ 15, pages 49 and 56", "url": "https://gc.nh.gov/house/calendars_journals/viewer.aspx?fileName=journals%5C2026%5CHJ%2015%20June%204%2C%202026.pdf", "kind": "record"}, {"label": "SJ 15", "url": "https://gc.nh.gov/senate/calendars_journals/Journals/2026/SJ%2015.pdf", "kind": "record"}], "amendments": [{"num": "2026-0887h", "kind": "Committee Amendment", "where": "committee", "date": "2026-03-11", "body": "H", "adopted": true, "vote_kind": "RC", "mover": "", "proposed_by": "", "text": "Proposed by the Majority of the Committee on Education Policy and Administration-r Amend the title of the bill by replacing it with the following: AN ACT modifying the structure and administration of home education programs.
