An open enrollment school is defined as any public school which, in addition to providing educational services to pupils residing within its attendance area or district, chooses to accept pupils from other attendance areas within its district and from outside its district. This bill changes how funding for open enrollment schools is sent and received, and also requires school districts to establish a line item in their budgets that reflects expenditures for open enrollment tuition costs. The Prospect Mountain School District currently operates the state's only open enrollment school, accepting students from outside the district's catchment area, which includes Alton and Barnstead. At this time, Prospect Mountain has 20 students at the school district under the open enrollment program. Current law compels sending districts to pay tuition for students participating in this program. However, school administrators and sending school boards in these districts are reluctant to pay tuition costs and this places an extreme financial hardship on the Prospect Mountain School District that strives to offer educational opportunity for all enrolled students, both within the district and outside the district. There are three primary reasons that sending districts refuse to pay tuition: (1) lack of clarity about payment responsibility, (2) differing opinions about which districts must or must not adopt the provisions of RSA 194-D, and (3) objections based on a board's authority to enter into other agreements, such as area agreements or tuition agreements with other school districts. This bill clarifies language in the law relating to the first of these points. Further, the bill clarifies financial responsibility of districts by clearly stating sending district or receiving district. Lastly, the bill inserts language that each school district shall establish a line item in their operating budget, on an annual basis, reflecting estimated expenditure for open enrollment school tuition. This is no different from current tuition expenditures when dealing with student placement based upon \"best interest\" or \"manifest education hardship.\" Parental requests for a change of school assignment due to a manifest education hardship are rarely approved at the local level, even after appeal to the State Board of Education. The open enrollment program is much different, as it provides an enrollment opportunity at the receiving school that may not be available at the sending school. It is particularly difficult to understand why sending districts object to enabling parents to make another educational choice that better serves their child; especially, when there is a 20% savings compared to other tuition or area agreement programs. Open enrollment keeps public dollars in public schools. This program allows students to take advantage of programming offered in a neighboring school that may not be offered in the student's resident school. As stated by the superintendent of schools at Prospect Mountain, \"I welcome any New Hampshire family to evaluate our strengths and weaknesses and decide for themselves where their children can be best served.\""}, {"side": "Minority", "author": "Rep. The open-enrollment school district and their taxpayers would fund the difference. This bill requires local taxpayers to subsidize students attending schools in other districts.
